The development of an online store is one of the basic and daily elements of work.

Campaigns are carried out in paid channels, and individual areas of the store are optimized with equal enthusiasm.

However, among all this the pillar of every online store cannot be omitted – the e-store terms and regulations are the key to running an e-business in a safe manner, a guarantee of good practices, certainty for e-customers that the store works fairly. The development of the online store is very limited if it does not have good regulations.

Developing an Online Store – Where to Begin?

The construction and development of an online store is a complicated process. It requires a strategy that will lead the store to get the expected conversion, and online campaigns to bring traffic that will be monetized. The e-store terms and regulations are extremely important, especially in the beginning. Without it, we basically cannot speak of any development. A lack of regulations, or even badly written ones with prohibited clauses, which are contained in the OCCP register, can lead to serious consequences.

It follows that the issue of how to write good online store regulations is the absolute basis for selling online. Penalties for the absence of regulations, or incorrectly worded paragraphs lead to large fines. The penalty from 2018 for UPC amounted to almost PLN 33 million, and the now defunct Emistomarket home appliances store was punished with a penalty of PLN 46,000. Good e-store terms and regulations are not only the basis for development, but an absolute “must have”, without which e-shops may be unable to continue operations.

How to Develop an Online Store: New and Old Customers?

On the one hand, the e-store must constantly look for new customers, while on the other, regular customers are usually the largest group of buyers. By the way, repeated orders generate almost negligible costs, compared to how much it costs to acquire a new e-consumer. How is this linked to the e-store terms and regulations? There is a certain difference between a new customer and an “old” customer. The first already knows the brand, he is aware of how it works, he likes to order in the store and not somewhere else. Therefore, in the case of any misunderstanding, poorly packaged or incomplete package, the customer will rather consider it a mistake and will want to resolve it in a friendly manner for each party. A new customer is more likely to check the online store regulations. The OCCP regularly adds more items to the list of prohibited clauses, and it may turn out that the regulations have not been updated in this respect and the customer will use it to his advantage. The development of an online store is not so independent of creating good regulations.

E-Store Terms and Regulations – The Basics

Each e-store is legally obliged to have regulations, which must be made available to customers free of charge and in such a way that the user can read the document before concluding the contract. What are the basic elements of the online store regulations?

  • company data – name, tax identification number, REGON, if the company has data about entry in the National Court Register, correspondence address,
  • information about the concluded contract – the regulations must specify the nature of the contract, the terms determining the rights and obligations of the seller and buyer, describe the payment methods, the date of performance of the contract, how the purchased product or service will be delivered, and the conditions for withdrawing from the contract and its termination,
  • scope of the entity’s activity – does it cover the territory of Poland or also, for example, the European Union,
  • complaint mode – the regulations must cover the scope of the complaint. The information applies to deadlines, authorizations and the entire process. It should be remembered that there are many ways of submitting complaints and the customer cannot be informed that he can use only one means.

How to Write E-Store Terms and Regulations?

Good e-store regulations are one that are fully transparent, up-to-date and do not contain prohibited clauses. There are many guides available in the web that explain how to create the terms and regulations of an online store. But how can we be sure if they have exhausted the topic, and if the guidelines are up-to-date or do not contain illegal clauses? Sometimes it is better to visit specialized companies that know how to prepare e-store terms and regulations. It should also be kept in mind that once written terms and regulations are not valid forever. They must be updated due to the fact that the OCCP regularly expands the clause database. Therefore, some records might have been correct when the regulations were first made, but after some time they may be considered harmful to consumers.

If we do not meet the basic condition of conducting e-business, the store may experience difficulties if it turns out that the rules of the store do not comply with the general guidelines. Then the development of the business will not only be impeded (significant funds may be absorbed by the penalty imposed by the OCCP), but it will even prevent further sales online.
